Walt Mossberg and I had an interesting debate recently over users rights and copyright in the modern era. These are complex issues and we went back and forth challenging each other on various scenarios in which users, DRM, and copyright were colliding. Today I had one and i thought I would put the question out to you guys before giving you the right answer (aka my answer :-).
Question: I just pre-ordered Bob Dylan's Moderm Times on iTunes. I'm sure the album will be available on the Internet before the release date, does my purchasing the album ahead of time give me the right to download it now? Is there any harm in me downloading it ahead of time?

1. To me that is a question of one's own personal ethic. One could easily make the case that stealing is wrong, plain and simple.End of story.
But then hasn't piracy enabled people who could not afford programs such as Photoshop to learn them and then get jobs demanding to use Photoshop? The extended 'try before you buy'. Is Abobe happy? Yes. Is the pirate/future buyer happy?. Yes. Piracy in this case is beneficial to the transaction. if looked at from a mlonger term perspecctive.
So in the same spirit d/ling a bit torrent file after you have made the purchase is simply like exercising you fair use to make a backup copy (just before the purchase it fully completed.)
